Data controller
Barrass Whiting LLP (“we” or “us”) are the data controller in respect of all personal data collected via our website or if you instruct us or propose to instruct us to act on your behalf. We are a limited liability partnership, registered in England and Wales under registration number OC440255.
The type of personal information we collect
We may collect and process the following information:
- Your name, address, e-mail address and telephone number (including any business address, e-mail address or telephone number you provide to us);
- Information relating to the issue you have contacted us or instructed us about;
- Bank account and payment card details or any other financial information you provide to us which is relevant to your instructions; and
- If you are interested in working for us or applying for a vacancy, any information you provide to us in relation to that (including information contained in any CV you supply to us).
How we obtain your personal information
Most of the personal information we have is provided to us directly by you. Sometimes we may obtain information from publicly available sources, for example, Companies House. We may also obtain information from a third party with your consent, e.g., from your employer if you have instructed us to contact your employer on your behalf.
Cookies
Information may also be collected via cookies. When you visit our website technical data about you (such as an IP address) may be automatically collected as you interact with our website. A “cookie” is a small piece of information sent by a web server to store on a web browser so it can later be read back from that browser.
Our website is a WordPress site and WordPress uses cookies to provide the user login functionality, and Google analytics will also collect visitor data. Our website also uses Google’s Recaptcha service to help prevent spam form submissions. The cookies set by Recaptcha are used to help us distinguish between humans and bots.

How we use any personal information we have
In most cases we will only use the information we have about you to provide the advice and assistance you have requested we provide. If you instruct us it will normally be necessary to use some personal information (e.g. your e-mail address) to comply with your instructions. We may also use personal information if necessary before you instruct us to help you to decide whether to decide to instruct us and to provide a fee estimate or quote.
We like to keep our contacts and clients up to date with changes to the law and information which we feel is likely to be of interest. From time to time we may use your personal information to send legal information, newsletters and invites to events we may be holding or speaking at. We may share personal information about you with third parties who are directly involved in dealing with any request or enquiry made by you (e.g. accountants you have instructed to advise on tax matters), any third parties who are providing us with advice in relation to your matter (e.g., a barrister or medical professional) or where the disclosure is required by law or is in connection with legal proceedings or prospective legal proceedings.
We will never sell your information or provide any information to a third party for marketing purposes.
Lawful basis for using personal information
Under the UK General Data Protection Regulation (UK GDPR), there are certain lawful bases on which we may rely when processing (which includes storing) personal information which relates to you. We may process personal information about you (including sensitive personal data known as Special Categories Data where relevant to your matter) if:
- It’s necessary to perform our contract with you or comply with a contractual obligation
- To comply with a legal obligation
- If we need to process your personal information because it’s necessary for our legitimate interests (e.g., for the running of our business, provision and administration of IT services, etc).
- You consent (for example, if you ask to be added to our mailing list). You are able to remove your consent at any time. You can do this by sending an e-mail to lee.whiting@barrasswhiting.co.uk and indicating that you withdraw your consent.
How we store your personal information
Your information is securely stored.
We only keep your personal information for as long as we need to for the purpose for which it was collected.
We will keep any personal information which relates to a matter you have instructed us in relation to after your matter is concluded. We need to retain this information in order to perform conflict checks, comply with our legal and regulatory obligations and deal with any future queries you may have about the matter. We normally keep such information for the duration of the matter and for six years after that.
If you receive legal updates and similar information from us, we will keep and use your name and e-mail address to contact you unless and until you notify us that you no longer wish to receive such information.
If we no longer need to keep personal information it will be securely deleted.
Your data protection rights
Under data protection law, you have certain legal rights including:
- Your right of access – You have the right to ask us for copies of your personal information.
- Your right to rectification – You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
- Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
- Your right to restriction of processing – You have the right to ask us to restrict the processing of your personal information in certain circumstances.
- Your right to object to processing – You have the the right to object to the processing of your personal information in certain circumstances.
- Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
You will not be required to pay any charge for exercising your rights, unless a request for access is clearly unfounded or excessive. In those circumstances we are legally entitled to charge a reasonable fee or refuse to deal with your request.

How to complain
If you have any concerns about our use of your personal information, you can make a complaint to us by writing to lee.whiting@barrasswhiting.co.uk.
You can also complain to the Information Commissioner’s Office (ICO) if you are unhappy with how we have used your data. However, we would appreciate the opportunity to deal with your complaint before you complain to the ICO.
